Terms of use

iRememberU is operated by Mega Coders LLC (“Company,” “we,” “us,” or “our”). These Terms govern your access to and use of the iRememberU application, website, and related services (collectively, the “Service”). By making an account, or adding to an occasion as a guest, you agree to them. Our privacy policy is part of them.
Account eligibility and child profiles
You must be at least 13 years old, or meet any higher minimum age required by applicable law, to create or operate your own iRememberU account. If you are below the age of majority where you live, you must have permission from your parent or legal guardian, who must review these Terms with you.
A parent or legal guardian who is at least 18 years old and has reached the age of majority where they live may create and manage a profile about their child under 13 through the adult’s own account. A child profile is not an independent user account and does not authorize the child to access or use the Service.
The parent or legal guardian must control the account credentials, uploads, invitations, and sharing settings associated with the child profile and have the authority and permissions necessary to provide the child’s information and content.
Keep your sign-in to yourself; what happens on your account is yours to answer for.
What you share is yours
Your photos, videos, recordings and words stay yours. You give us permission to store them, make copies in the sizes a phone needs, and show them to the family and guests you share them with — that, and nothing more. We don’t sell them, publish them, or use them to advertise.
When you share something with your family it becomes part of their story too: it stays with them if you later leave or close your account, unless you remove it first.
User content and sharing
You are responsible for the content you upload and for obtaining any rights and permissions required to upload and share it. Before sharing photographs, videos, or other personal information, including information about children, consider the people who will be able to access it. Recipients may download, copy, or redistribute shared content, and removing content from the Service may not remove copies previously obtained by others. This paragraph does not limit our obligations under applicable privacy or data-protection laws.
What we ask
Don’t use iRememberU to break the law, to harass or harm anyone, to share sexual content involving minors or anything else illegal, to upload things that aren’t yours to share, or to break into, overload or copy the service. We can remove content or close an account that does, and we’ll report what the law requires us to report.
If someone in a family or an occasion shares something that shouldn’t be there, the people who run that family can remove it and the person. You can also tell us at support@irememberu.app.
Service availability and backups
To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation or that stored content will never be lost or corrupted. You should maintain independent backups of important photographs, videos, and other memories. Nothing in this paragraph overrides an express commitment we make to you or any rights that cannot legally be waived.
You can save any photo or video back to your phone. If we ever had to close iRememberU, we’d give families reasonable notice first, so there is time to save what matters.
Leaving
You can stop using iRememberU and delete your account at any time.
Limitation of liability
To the fullest extent permitted by applicable law, Mega Coders LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the Service, including lost profits or loss of data, even if advised of the possibility of those damages.
Subject to the exceptions below, Mega Coders LLC’s total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) $100 USD or (b) the amount you paid to Mega Coders LLC for the Service during the 12 months immediately preceding the event giving rise to the claim.
These exclusions and limitations do not apply to fraud, willful misconduct, gross negligence, or any liability that applicable law does not allow to be excluded or limited. Your non-waivable statutory and consumer rights remain unaffected.
Governing law and changes
These terms are governed by the laws of the State of Florida.
If we change these terms in a way that matters, we’ll tell you by email or in the app before the change takes effect; carrying on using iRememberU after that means you accept them. Questions: support@irememberu.app.
